Small claims court is a special division of the civil court system designed to resolve disputes involving relatively small dollar amounts quickly, inexpensively, and without requiring the parties to have attorneys. Most security deposit disputes fall well within small claims limits -- dollar limits range from $2,500 to $25,000 depending on the state ($10,000 in California, $20,000 in Washington, $10,000 in Texas). Procedures are simplified: there are no formal discovery rules, no complex motion practice, and hearings are informal. The filing fee is typically $30 to $100. To prepare for small claims court, tenants should bring: the lease, the original move-in condition report, all written communications with the landlord (texts, emails), the demand letter and proof of mailing, photographs from move-in and move-out, and any other evidence of the deposit paid and withheld. The judge will hear both sides and issue a decision, often the same day. Note that even if the tenant wins, collecting on a judgment is a separate process.
