1. Agreement to Terms
By accessing or using GetItBack ("Service"), operated at getitback.us, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We may update these terms at any time; continued use after changes constitutes acceptance.
2. Service Description
GetItBack provides a web-based tool that analyzes user-provided information against publicly available state security deposit statutes. Based on that analysis, the Service identifies potential violations and calculates amounts that may be owed. For a one-time fee of $19, users may generate a personalized demand letter in PDF format.
3. Not Legal Advice
GetItBack provides general legal information only, not legal advice. Use of this Service does not create an attorney-client relationship. The analysis is based on publicly available statutes and may not reflect recent amendments, local ordinances, judicial interpretations, or case-specific factors. You should consult a licensed attorney in your jurisdiction for advice specific to your situation.
4. User Responsibilities
By using the Service, you represent and warrant that:
- All information you provide is truthful and accurate to the best of your knowledge.
- You are at least 18 years of age or the age of majority in your jurisdiction.
- You will not use the Service for any fraudulent, abusive, or unlawful purpose.
- You understand that the accuracy of the output depends on the accuracy of your input.
5. Payments & Refunds
Payments are processed securely through Stripe. The $19 fee is a one-time charge for generating a personalized demand letter. Because the letter is a digital product delivered instantly, refunds are generally not provided once the letter has been generated. However, if you experience a technical issue that prevents delivery, contact us at support@getitback.us and we will make it right.
6. Accuracy & No Guarantees
While we strive to maintain accurate and current legal information, we make no guarantees regarding the accuracy, completeness, or timeliness of the data. State laws change, and our database may not always reflect the most recent amendments. We do not guarantee any particular outcome from sending a demand letter.
7. Intellectual Property
All content, design, code, and branding on GetItBack are owned by us or our licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without prior written consent. The demand letter generated for you is licensed for your personal, non-commercial use only.
8. Limitation of Liability
To the fullest extent permitted by law, GetItBack and its operators, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service. This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the Service ($19).
9. Indemnification
You agree to indemnify and hold harmless GetItBack and its operators from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or any dispute between you and your landlord.
10. Dispute Resolution
Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation by contacting us. If unresolved within 30 days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
11. Termination
We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
