Bad faith withholding is the highest standard of landlord misconduct in security deposit law, requiring evidence that the landlord acted with dishonest purpose, not merely negligence or even deliberate disregard of the deadline. Some states -- notably Texas -- require proof of 'bad faith' before the 3x penalty can be awarded. Courts consider bad faith established when there is affirmative evidence of deceptive or dishonest conduct: fabricating deductions, refusing to return a deposit that the landlord knew was owed, making deductions the landlord knew were legally impermissible, or retaliating against the tenant for asserting their rights. The distinction between willful withholding and bad faith is often subtle: willful means the landlord knew what they were doing but may have believed (incorrectly) that they were entitled to keep the money; bad faith means they knew they had no legal right to it. Documenting the landlord's communications and the timeline of events is critical to establishing a bad faith claim.
