Punitive damages are a distinct category of court-awarded compensation designed to punish defendants for outrageous conduct and deter similar behavior, rather than merely compensating the plaintiff. In security deposit cases, punitive damages are relatively rare because most states provide for statutory multipliers (2x or 3x) that serve a similar deterrence function. However, in cases involving particularly egregious landlord behavior -- such as forging documents, coordinated schemes to defraud multiple tenants, harassment after the tenant asserted their rights, or discrimination combined with deposit theft -- a court may award punitive damages on top of the statutory remedies. Punitive damages are typically available only if the tenant can show that the landlord's conduct was intentional, malicious, fraudulent, or in reckless disregard of the tenant's rights. Unlike the statutory multiplier, punitive damages are discretionary and require a higher evidentiary showing, making them more appropriate for cases filed in civil court than in small claims.
